Terms of Service
Effective Date: March 16, 2025
In this document, the term "Wayy" shall refer to "The Playground Work Limited." Wayy provides an online social networking service. This agreement encompasses Wayy’s policies regarding acceptable use of the Wayy services and content posted on the Wayy application, as well as your rights, obligations, and restrictions concerning your use of the Wayy services and Wayy’s Terms of Service. Our mobile application is currently available on iOS devices and will be available on Android devices in the near future. If you do not agree to be bound by this agreement, you may not use the services provided by Wayy. Your use of certain services within Wayy may be subject to additional terms, which will be presented to you upon accessing those services.
Important Notices
Before proceeding with the details below, the following important points must be noted:
Users must be at least 18 years of age to utilize the services provided by Wayy.
Wayy does not conduct any criminal background screenings on its users.
There is no formal identity verification process in place.
Wayy does not guarantee any specific outcomes regarding the services, including user actions.
Wayy does not guarantee the number, frequency, or quality of matches. As a user, you are responsible for your actions while using the services and communicating with others within the application.
Eligibility
To create an account on Wayy and utilize the services, you must be at least 18 years old. By creating an account and/or using the services, you represent and warrant that you meet this age requirement. To create an account, you must provide your mobile number and agree to Wayy’s user agreement, which governs the treatment of your information. You may also provide additional information, such as gender, age, and hobbies, to receive more customized services.
Privacy of Personal Information
Except as permitted under these Terms of Service or as otherwise consented to by you, Wayy will not transfer your personal information to any third parties for any purposes. Wayy permits sharing and/or collection of information for the following purposes: (i) providing Wayy’s services to you; (ii) fulfilling Wayy’s obligations and enforcing its rights under these Terms of Service; and (iii) for Wayy’s business purposes, including improving its services.
Non-commercial Use by Members
The services provided by Wayy are intended solely for personal use by members and may not be utilized in connection with any commercial endeavors unless specifically endorsed or approved by Wayy. Unauthorized use of the services, including the collection of usernames and/or email addresses for unsolicited communications, is strictly prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from member profiles without notice and may result in termination of membership privileges. Legal action may be pursued for any illegal or unauthorized use of the services.
Changes to Agreement or Services
Wayy reserves the right to update this Agreement at any time at its sole discretion. Users will be notified of updates either by posting the revised Agreement on the Site and App or through other communications. It is essential to review the Agreement whenever updates occur or when using the Services. Continued use of the Services after an update constitutes acceptance of the revised Agreement. If you do not agree to the updated Agreement, you must cease using the Services. Wayy may change or discontinue any part of the Services at any time without notice.
Content Posted in Wayy
Wayy reserves the right to delete any content that, in its sole discretion, violates this agreement or is deemed offensive, illegal, or threatening to the safety of any individual. Wayy assumes no responsibility for monitoring user-generated content.
Prohibited Content
You agree not to engage in any of the following activities, which may result in account termination and/or legal action:

Promoting racism, bigotry, hatred, or physical harm against any individual or group.

Harassing or advocating harassment of another person or user.

Exploiting individuals in a sexual or violent manner.

Posting links to adult websites or content containing violence or offensive material.

Soliciting personal information from individuals under 18 years of age.

Posting false or misleading information to promote illegal activities.

Promoting illegal or unauthorized copies of copyrighted works.

Engaging in any illegal or criminal activities.

Promoting commercial activities without Wayy’s consent.

Posting photographs of others without their consent.
Copyright Policy
Wayy respects the intellectual property rights of others and expects its users to do the same. Wayy reserves the right to disable and/or terminate the accounts of users who repeatedly infringe or are charged with infringing the copyrights or other intellectual property rights of others. If you are a copyright owner or authorized to act on behalf of one, please report alleged copyright infringements occurring on or through the Site by delivering a notice to Wayy. Upon receipt of such notice, Wayy will take appropriate action, including removal of the challenged material.
Member Disputes
You are solely responsible for your interactions with other members of Wayy. Wayy reserves the right, but has no obligation, to monitor disputes between you and other members.
Privacy
Use of the services provided by Wayy is also governed by Wayy’s Privacy Policy, which is incorporated into this agreement by reference.
Use of Paid Features
Wayy may offer certain premium services for a fee. You may choose to make a one-time payment or purchase a subscription for such premium services. Examples of premium services may include additional matches per day or profile picture appraisals. Certain value-added services require payment for use. You must select and purchase the required services on the purchase page and make the payment accordingly. At the time of purchase, you should verify the category, price, quantity, duration, method of use, and renewal period of the order. Once payment is made, it is deemed confirmed, and modifications or refunds may not be requested unless otherwise provided by law. If you purchase a subscription, it will automatically renew unless canceled before the end of the current subscription period. By agreeing to this Agreement and purchasing a subscription, you acknowledge the recurring payment features and accept responsibility for all payment obligations prior to cancellation.
Disclaimer
Wayy is not responsible for any incorrect or inaccurate content posted on the Wayy app. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We do not guarantee the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content.
Limitation on Liability
In no event shall Wayy be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits arising from your use of the services, even if Wayy has been advised of the possibility of such damages. Notwithstanding anything to the contrary, Wayy’s liability to you for any cause whatsoever will be limited to the amount paid, if any, by you to Wayy for the services during your membership term. Wayy shall not be liable for damages or losses caused by your or a third party’s actions or omissions.
Disputes
Any disputes arising from or related to the services provided by Wayy shall be governed by the laws of Hong Kong, without regard to conflict of law provisions. Either Wayy or you may demand that any dispute be settled by arbitration in accordance with the dispute resolution procedures of Hong Kong, without preventing Wayy from seeking injunctive relief in a competent court. The arbitration award shall be final and binding.
